This is a list of questions and answers to be discussed at The Village Council Meeting on Tuesday, June 12th Regarding the Proposed Docks at Veterans Park on Swan Street.

Re: Floating Docks at Veterans Memorial Dock

Concerns and Questions on Floating Docks at Veteran Memorial Park/Boat Launch (there may be more questions as this process moves forward.) This is an updated list from June of 2015.
A committee of six individuals; 2 each from the Park Committee, Planning Commission, and DDA were given the task to either approve or deny this project. Questions were given to the DDA to give firm answers on, however they never responded. As such the Park Committee, on July 23, 2015, moved to deny the installation. That was reported to the council in August of 2015 and the council took no further action. 

In speaking with Jim Hnilo, Ted Hartleb Insurance Agency, he stated that liability wise we would be covered. However, further coverage would depend on the amount of claims filed. His, and that of the underwriters of this policy, question the overall operation of the program, which has never been addressed. At this point I would ask the Parks Committee to readdress this project.What community organization is proposing the instillation of docks at the Vet eran’s Memorial Park?

THIS IS A GROUP OF CONCERNED BUSINESS PEOPLE AND CITIZENS THAT WISH TO ENHANCE THE VILLAGE.

Why are they proposing this?
THIS WILL GENERATE THOUSANDS AND THOUSANDS OF DOLLARS TO OUR VILLAGE AND THE LOCAL BUSINESSES THAT SERVE US.  THIS WILL GREATLY ADD TO THE AESTHETICS OF COLON, SWAN PARK (VETERAN MEMORIAL PARK), GENERATE MORE FOOT TRAFFIC TO THE VILLAGE,  BUILD COMMERCE, AND BETTER THE QUALITY OF LIFE TO ALL THAT ENJOY OUR LAKES AND OUR VILLAGE.

Who is purchasing these docks? Total cost?
THE MONIES COLLECTED WILL BE DONATED TO THE VILLAGE, AND SPECIFICALLY EARMAKED FOR THIS PROJECT.
If someone else purchases these docks and since these docks are used on Village of Colon property will the Village assume ownership of them?
THE COLLECTED MONIES WILL BE DONATED TO THE VILLAGE.  THE VILLAGE WILL OWN THE DOCKS, AT NO COST TO THE VILLAGE.

If the Village assumes ownership of these docks will the purchaser of said docks require some kind of legal contract or agreement of use?
THE VILLAGE WILL OWN THE DOCKS.  THEY WILL BE PURCHASED, AT COST, FROM LAKESIDE MARINA. 

Who will be responsible in the spring for putting in the sections and who pays for this? Who will determine the date of installation in spring?
THE OWNER OF THE LOCAL BUSINESS, LAKESIDE MARINA, HAS GENEROUSLY OFFERED TO SELL THE DOCKS TO THE VILLAGE AT HIS COST.  A GROUP OF CONCERNED CITIZENS HAS AGREED TO INSTALL AND REMOVE THE DOCKS PER SEASONAL REQUIREMENTS, AT PROPER SEASONAL TIMES, AT NO CHARGE. 

Who will be responsible in the fall for taking out sections and who pays for this? Who will determine the date for removal of docks in the fall?
THE OWNER OF THE LOCAL BUSINESS, LAKESIDE MARINA, HAS GENEROUSLY OFFERED TO SELL THE DOCKS TO THE VILLAGE AT HIS COST.  A GROUP OF CONCERNED CITIZENS HAS AGREED TO INSTALL AND REMOVE THE DOCKS PER SEASONAL REQUIREMENTS, AT PROPER SEASONAL TIMES, AT NO CHARGE. 

Who will be responsible for maintaining these docks and cost of repairs?
DOCKS ARE VIRTUALLY MAINTENECE FREE AND WILL LAST FOR YEARS.

Who will be responsible for moving and storing of sections?
THE AFOREMENTIONED GROUP WILL REMOVE AND STORE THE DOCKS. 

Where will sections be stored?
WE SUGGEST STORING THEM AT THE BARN AT THE COMMUNITY PARK, OR THE DPW GARAGE, OR SIMPLY OUTSIDE AT THE PARK

If the company installing and taking out the docks goes out of business or decides not to continue that job after a period of time does that become the responsibility of the Village?
LAKESIDE MARINA HAS BEEN IN BUSINESS FOR YEARS.  THEY HAVE VERY CHARITABLY OFFERED TO ASSIST OUR GROUP WITH THE INSTALLATION AND REMOVAL OF THE DOCKS. IN THE ENSUING YEARS WE WILL CONTINUE TO RECRUIT NEW MEMBERS AND VOLUNTEERS TO OUR GROUP.

Firm number of proposed docks. 1,2,3,4?
     WE FEEL ECONOMIES OF SCALE DICTATE THAT WE SHOULD PURCHASE T LEAST 4 DOCKS AT THE ONSET. Firm length based on ADA of 17’ to include 7’ ramp and 10’ floating section?
DOCKS WILL BE 22’8” AND ADA COMPLIANT Will all docks need to be ADA accessible? Will docks have handicap rails? RAILS WLL BE ON THE RAMP, RAILS ARE NOT REQUIRED ON THE DOCKS.

Will one of the docks be posted handicap parking?
AT LEAST ONE WILL ALL BE HANDICAP ACCESSABLE
All ADA questions need to be researched and answered. THIS HAS BEEN DONE

0” THIS DOCK SHOULD BE ADJACENT TO THE BOAT RAMP.  CURRENTLY ONE HAS NO WAY OF LOADING OR UNLOADING A BOAT BY THEMSELVES.  A DOCK PLACED HERE WILL GIVE A BOATER THE OPPORTUNITY TO TIE THE BOAT OFF AS THEY MOVE THEIR VEHICLE AND TRAILER TO AND FROM THE RAMP

Firm distance from last section to south edge of property/park.
WE HAVE SPOKEN TO THE ADJACENT LAND OWNER, DR. SMOLARZ AND THEY HAVE AGREED TO HAVE THE LAST DOCK TO THE SOUTH X FEET FROM DR. SMOLARZ FENCE.  ON SITE PLAN

Approximate number of boats/pontoons that can be parked at any one time.
FOUR DOCKS WILL GIVE THE OPPORTUNITY FOR 7 BOATS TO BE TIED OFF AT ONE TIME. (THE DOCK FURTHEST NORTH WILL ONLY ALLOW FOR ONE BOAT TO BE TIED OFF, AS THE FURTHEST NORTH SIDE OF THIS DOCK WILL BE LEFT OPEN FOR LOADING AND UNLOADING BOATS.

THERE WILL BE A SIGN TO BE PLACED STATING THAT THESE DOCKS HAVE BEEN PAID FOR BY DONATED FUNDS.

 How close can pontoons be pulled up to seawall?
ALL BOATS WILL PULL IN PERPENDICULAR TO THE SEA WALL AND THEREFORE WILL BE ABLE TO TOUCH IT.  THIS IS THE SAME AS THE CURRENT SITUATION.

Will pontoons/boats be allowed to be moored at north section next to the boat ramp? (For purposes of take in or out? Docking)?
THE FURTHEST NORTH SIDE OF THE FURTHEST NORTH DOCK WILL REMAIN OPEN AND USED ONLY FOR LOADING AND UNLOADING OF BOATS

Will there be a limit on docking? Who will police this?
NO OVERNIGHT PARKING.  WE FEEL MOST BOATERS AND PATRONS, WILL USE THE DOCKS FOR LESS THAN 2 HOURS. IF SOMEONE IS MERELY PICKING UP TOGO FOOD ORDERS, BAIT, POP, AND/OR SNACKS, THEY WILL LIKELY BE IN TOWN LESS THAN 15-25 MINUTES.  POLICING WILL BE DONE AS ANY OTHER POLICING IS DONE.

Will the village be allowed to charge an hourly fee for parking? If so, how could this be accomplished in the most effective manner?
WE DO NOT SUGGEST CHARGING A FEE AT THIS TIME, NOR DO WE SEE THAT AS A NECESSITY AS TIME GOES ON.  THERE IS NO PAID PARKING ANYWHERE IN THE VILLAGE CURRENTLY.

Will there be overnight docking? Who will police this?
WE SUGGEST NO OVERNIGHT PARKING.  WE SUGGEST OPENING AT DAYLIGHT AND CLOSING AT 12 PM.  THIS WILL BE NO DIFFERENT THAN POLICING ANYTHING ELSE.  IN FACT, MORE EYES IN TOWN ON A DAILY BASIS COULD ACTUALLY HELP PREVENT ANY PROBLEMS.

Will there be set times when parking opens and closes at the docks? Who will police this?
WE SUGGEST NO OVERNIGHT PARKING.  WE SUGGEST OPENING AT DAYLIGHT AND CLOSING AT 12 PM.  THIS WILL BE NO DIFFERENT THAN POLICING ANYTHING ELSE.  IN FACT, MORE EYES IN TOWN ON A DAILY BASIS COULD ACTUALLY HELP PREVENT ANY PROBLEMS.

Will fishing be allowed on the docks? Who will police this?
FISHING ALLOWED WHILE NO BOATS PRESENT.  THIS WILL BE POSTED. IT IS NOT PATROLLED NOW.
If there is fishing can people take their lawn chairs out to the end of the dock to sit and fish?
FISHING ALLOWED WHILE NO BOATS PRESENT. IT IS A PUBLIC DOCK.

Is there a maximum number of people that can be on the dock at one time? Who will police this?
NO, THE DOCKS ARE RATED FOR MORE POUNDS PER SQUARE INCH THAN PEOPLE CAN FIT.

What happens when boaters & individuals fishing come into conflict? Who will police this?
HOPEFULLY WE ARE ALL MATURE ENOUGH TO SHARE.  IT HAS BEEN DONE ALL DAY, EVERY DAY, EVERY SEASON, FOR YEARS ON THE LAKES.  THIS WILL BE POLICED AS EVERYTHING ELSE IS.

Who will be responsible for damage to the docks?
THE DOCKS WILL BE COVERED UNDER THE VILLAGE’S INSURANCE POLICY.  THEREFORE ANY MAJOR DAMAGE WILL BE COVERED.  THE DOCKS HAVE A 10 YEAR WARRANTY. 

Who will be responsible for any damage or theft to private property on/in pontoons or boats?
ALL BOATERS WILL BE RESPONSIBLE FOR THEIR PRIVATE PROPERTY AND THE DOCKS WILL BE POSTED TO THIS AFFECT.

Will there be signage on or near docks for:No swimming?                YES

No fishing?                 FISHING IS ALLOWED WHEN NO BOATS ARE DOCKED.

Tie up at your own risk?

Village not liable for damage of any kind?

     NO, THE DOCKS ARE RATED FOR MORE POUNDS PER SQUARE INCH     

     THAN PEOPLE CAN FIT.     g.   No children allowed on the docks without adult supervision.    YES, AGE TO BE DETERMINED BY THE VILLAGE. 

   
  h. Who pays for this signage?     OUR GROUP WILL RAISE FUNDS FOR THIS SIGN AS WELL   

Will there be a need for lighting on docks or shore and how much? Who will be responsible for installation of needed light? Cost?
AS WE WILL NOT OPEN UNTIL DAYBREAK AND CLOSE AT 12 PM, WE DO NOT FEEL ANYMORE LIGHT IS NEEDED.  THERE IS ALREADY A STRRET LIGHT AND THERE CURRENTLY IS NO LIGHT ON STURGEON LAKE DOCK.

Will docks be closed to watercraft after a set time on the 4th of July?
THE PARK IS ALREADY CLOSED DURING THE FIREWORKS ON THE 4TH OF JULY.

Will docks be closed to all individuals after a set time on the 4th of July?
THE PARK IS ALREADY CLOSED DURING THE FIREWORKS ON THE 4TH OF       JULY.

What is an estimated number of boats on Palmer Lake and channel going south to Long Lake?  
WE HAVE NO IDEA.  ONE CAN ONLY HOPE THAT MANY MORE BOATS TRAVEL THE OTHER DIRECTION -  NORTH  - TO VISIT OUR WONDERFUL LITTLE VILLAGE.

There are a lot of questions that the council should be concerned with. These questions need to be answered. It is just not a matter of installing them and them making up the policies to govern them as things happen. When that happens, for all practical purposes, things go to heck in a handbasket.
